The following terms and conditions apply to all bookings made at this hotel.
We kindly ask that you take a moment to read them prior to your arrival.
In these terms and conditions, the following definitions apply:
A credit or debit card is required to secure your reservation. There will be no cancellation charge if a booking is cancelled before 15:00GMT one day before your date of arrival. If the booking is cancelled later, or in the case of a no-show, the first night will be charged.
Any pre-paid room bookings are non-refundable and will not be refunded if the booking is cancelled prior to the guests arrival
“Company” or “we” means Hoghton Leisure Ltd (company no:05608782) whose registered office is at the Oak Royal Hotel Golf and Country Club, Bury Lane , Withnell, PR6 8SW. “booking” means the booking for accommodation, functions and/or any other services or items made with us. “Contract” means the booking and these terms, and any other terms and conditions stated to apply to the booking. “Terms” means these terms and conditions. “VAT” means value added tax.
All bookings at the hotel are subject to these terms and conditions. At the time of booking or at check in, we will take your credit/debit card details and pre-authorise the card for additional extras. You authorise the use of this card for any sums that become owing to us. Payment is taken in advance on the card used to secure the reservation. We also have the right to require full payment in advance or deposit at the time of booking in certain circumstances or if the booking includes the supply or certain items of services.
No booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided. If the hotel account is being paid for by a third-party credit or charge card, we will require the third party to sign an authority, which will permit us to charge your account to the credit or charge card, prior to checking in to the hotel.
The prices displayed on the websites are an average per night per room until a rate is selected. Any meals, service or VAT (at the prevailing rate) are included only if specified. A minimum length stay, deposit, cancelation charge and other conditions may apply to certain rates as specified. The VAT breakdown shown is indicative based on the current rate of VAT, and the expected VAT treatment of the goods and services. VAT will be payable at the prevailing rate applicable at the tax point of the invoice or booking confirmation issued and may change depending on the actual rate and the VAT treatment of the goods and services purchased at that date. Price lists for room rates, additional items, such as restaurant meals and room service are on display at relevant locations within the Hotel and are available upon request at reception.
Check in/Check out Time
In the interest of security and to prevent fraud, at the time of check in guests may be required to confirm their identity by providing their booking reference and their passport or identity card/passport/driving licence. If guests are traveling from outside the UK, Ireland or any country in the commonwealth we are also obliged by law to require guests to provide the number and place of issue of their passport/identity card and details of their next destination. These records will be kept for at least 12months and may be disclosed or made available for inspection by any police officer or as otherwise required by applicable law in the connection with the prevention or investigation of crime. The information above can be requested for each member of the party over the age of 16 and we reserve the right to refuse entry to persons who cannot provide the information set out above. Unless otherwise stated on the booking confirmation. Guests may check in to the hotel any time from 15.00pm on the scheduled day of arrival. On the day of departure, we kindly ask all guest to vacate the rooms by 10.00am (unless a late departure has been authorised or stated as part of your booking). Any guests still occupying rooms without an authorised late check out, later than 10.00am will received additional charges of £25.00 per hour. Cancelation Policy and No Shows
The cancelation policy of the hotel is that in the normal course of business bookings are cancellable without charge up to 15.00pm the day before arrival. Cancelation and non-arrival charges apply after the relevant time and will be charged to the credit/debit card supplied at the time of booking. We reserve the right to charge for one night’s accommodation per room booked if the above cancelation requirements are not met. If the booking is for the provision of multiple rooms, block booking of rooms for an extended period and/or additional services are to be provided by the hotel to meet specific needs of our guests then the cancelation policy will be discussed and agreed with out representative of the hotel at the time of the initial booking.
Cards used to secure bookings will be charged at 15.00pm the day before arrival to cover the cost of accommodation. If for whatever reason the hotel is unable to take payment for the booking, the reservation will be cancelled out of the system without notice. We accept the following methods of payment: credit cards: Mastercard, Visa; debit cards – visa/delta and visa/electron, Maestro. For advance purchase rates, the card you booked with must be present on arrival, along with the appropriate ID. At the time of check in we will pre-authorise a card (VAT and any service charge) for anticipated incidentals for the duration of your stay against your credit/debit card. During your stay, the Hotels system will calculate the incidentals charged to your room daily. If the cost of those incidentals exceeds the pre-authorisation done on check in, further authorisation will automatically be requested and if such authorisation is not available, we may request another method of settlement or a deposit to be provided, failing which we reserve the right to restrict access to your room. All outstanding charges must be paid in full on check out from the hotel. If the outstanding charges do not exceed the authorisation taken on check in the authorisation amount for the amount not utilised will be released, however we cannot control how long it takes for your bank to affect such release. If staying for multiple nights at the Hotel we may require you to make payment for any outstanding charges on a more frequent basis during your stay.
Changes or Cancelation by the Company
Very occasionally we may need to cancel your booking. In such circumstances, you will be given a full refund, if payment has already been received. But we shall have no further liability to you arising out of such cancelation. We will, however, use reasonable endeavours to try and re-locate any confirmed bookings cancelled by us to an alternative location similar in standard to the hotel.
In the event that no room is available, we will endeavour to find suitable alternative accommodation of an equal or better standard to the Hotel holding the guests guarantee booking.
We reserve the right and you hereby authorise us to charge your credit or debit card for any damages incurred to your room or hotel including hotel property during your stay (including without limitation specialist cleaning) or for any items missing when you leave.
Dependant on your individual needs a selection of specially designed rooms are available at the hotel. Please contact our team on 01254 830616 (option 1) to discuss specific requirements and the availability of appropriate accommodation, and we will do our best to accommodate your needs.
Guest must report any loss of/or damage to property immediately on discovery to the hotels reception or other appropriate staff member and shall assist with any reports made by the hotel to the police.
Any items left or lost while at the hotel are the owners responsibility, any items found at the hotel are kept for 28days and then discarded. In the event of you wanting your item returned, the cost of postage will need to be covered plus an additional £5.00 surcharge. The hotel and company are not responsible for the loss or damage of any items once posted back to the guest.
In the event of a damaged or lost room key there is a minimum charge of £25.00 to cover the loss of the key and fob. If payment is completed for the lost room key and it is return to the hotel within 7 days the money can be refunded any time after the money is non-refundable. In the event of having to call out a third party to fix a lock or room key the cost of a replacement fob and key plus any additional charges from the third party need to be covered in full. You hereby authorise us to charge the card presented on arrival to the hotel to be charged the final amount due.
The Oak Royal Hotel Golf and Country Club has its own private car park. Cars and their contents are left at the owners/customers own risk. We do not accept responsibility or the loss or damage to any vehicle or its contents.
Guests are requested to conduct themselves appropriately at all times and to comply with company procedures and/or requests with regard to conduct and respect for the property of the hotel, its employees and guests and their health and safety. Guests are requested not to disrupt the comfort and enjoyment of other guests, the smooth running of the hotel, or cause offence to other guests, golf members or staff members of the Hotel. The Hotel reserves the right to refuse a guest entry and accommodation if, on arrival, management reasonably considers that the guest is under the influence of drink or drugs, is unsuitably dressed or is behaving in a threatening manner, abusive or otherwise unacceptable manner. In addition, we reserve the right to refuse accommodation or service or remove you and members of your party from the hotel, if in our reasonable opinion we consider this provision to have been breached. Where this is the case we will have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.
Guests shall not enter areas of the Hotel which are indicated as being closed to the public. The Hotel or company shall not be responsible for death, personal injury or loss or damage to property suffered by a guest in such areas. The Hotel shall not be liable to a guest for any loss or damage to property caused by the misconduct or negligence of a guest or an act of god, or where the guest remains in exclusive charge of the property concerned.
Guests are advised that smoking within the Hotel is strictly prohibited, this includes E-cigs and Vapers as well as any other smoking devices. All bedrooms and communal areas are non-smoking. If you smoke within the bedrooms the hotel reserves the right to charge a minimum of £100.00 (in respect of cleaning and deodorising the bedroom) from the credit or debit card supplied by the guest as a guarantee or by the card used on check in for pre-authorisation. If you tamper with or set of the fire detection system you will be fined £150.00 and will be reported to the police. You will be liable for any costs incurred.
All children (a person under the age of 16) staying at the Hotel must be accompanied by an adult and must be supervised by an adult at all times. Extra beds are available at the hotel upon request and are subject to availability and limited. These come at an additional cost of £17.50 per bed. The extra beds can only be allocated to certain rooms within our hotel and are for children under the age of 14.
Guide dogs are accepted with prior arrangement, but otherwise no pets are allowed at the Hotel.
The Company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a force of majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of god, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
Limitation of Liability
The Company will not be responsible for the loss or damage of any property left in the Hotel other than required under the Hotel Proprietors Act 1956 and the current licensing act or any other applicable law.
The company will not be liable for any indirect, consequential or pure economic loss or any loss of profit, goodwill or opportunity (whether caused by the negligence of the Company, its employees, contractor or agents or otherwise) The Company’s total liability shall not exceed the value of the charges received by it under the contract. Nothing contained in the contract or in any other document referred to or incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by the company’s negligence or liability for fraud or fraudulent misrepresentation.
Governing Law and Jurisdiction
The contract and any not contractual obligations arising about it are Governed by English Law. The English courts have exclusive jurisdiction to determine any dispute arising about the contract including disputes relating to non-contractual obligations. Each party irrevocably waives any objection which it may now or later have to proceedings being brought to English courts (on the grounds that the English courts are not a convenient forum or otherwise).
